An exception which permits disclosure without consent is disclosure to school officials with legitimate educational interests, e.g., faculty, students and staff serving on general education or other learning outcomes assessment committees. A school official has a legitimate educational interest if the official needs to review an educational record to fulfill their professional responsibility. A school official is a person employed by the College in an administrative, supervisory, academic or research, or support staff position (including law enforcement unit personnel and health staff); a person or company with whom the College has contracted (such as an attorney, auditor, or collection agent); a person serving on the North Dakota State Board of Higher Education; or a student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks. Additional exceptions which permit disclosure without consent include: • The release of educational records to another North Dakota University System school provided the student seeks or intends to enroll or has applied for admission to the second institution. • The release of educational records in compliance with a judicial order or subpoena. • The release of educational records in an emergency in order to protect the health or safety of students or other persons. 4. The right to file a complaint with the U.S. Department of Education concerning alleged failures by Dakota College at Bottineau to comply with the requirements of FERPA. Emergency Closing of the College The Dean of the College will determine if the campus is to be closed due to extreme weather or other emergency conditions. The college's emergency notification system, Assurance NM, will also be used as a way to inform on emergency closings.
